CUSTOMER WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK AGREEMENT

Business: GoatCamping Rentals


1. Acknowledgement of Risks

I, the undersigned Customer/Renter, acknowledge that camping, travel, driving, towing, outdoor recreation and the use of recreational equipment involve inherent and other risks that may result in property damage, personal injury, serious injury, illness, or death.

These risks may include, but are not limited to:

  • vehicle accidents, collisions, rollovers or towing incidents;
  • road, highway, weather and traffic conditions;
  • use of a camping trailer, RV, motorhome or other rental vehicle;
  • towing, hitching, unhitching, loading or unloading;
  • use of camping equipment and recreational equipment;
  • fire, propane, fuel, electrical or other equipment-related hazards;
  • slips, trips and falls;
  • uneven, wet, icy, rocky or otherwise hazardous ground conditions;
  • falling objects, branches or other natural hazards;
  • wildlife and encounters with animals or insects;
  • water-related activities, including canoeing, kayaking or swimming;
  • activities at campgrounds, parks, trails and other recreational areas;
  • actions or omissions of other persons;
  • weather, environmental and other conditions beyond the control of GoatCamping Rentals.

I understand that these risks may exist even when reasonable safety precautions are taken.

2. Voluntary Participation and Assumption of Risk

I voluntarily choose to rent and use the vehicle, camping trailer and/or recreational equipment provided by GoatCamping Rentals.

I acknowledge that I have had an opportunity to inspect the rental equipment and ask questions about its operation and safety.

I agree to use the rental equipment only for its intended purpose and in accordance with all instructions, applicable laws, campground rules, manufacturer instructions and directions provided by GoatCamping Rentals.

I voluntarily assume the risks associated with my use of the rental vehicle, camping trailer and/or recreational equipment, to the extent permitted by applicable law.

3. Release of Liability

To the fullest extent permitted by applicable law, I release and agree not to make a claim against GoatCamping Rentals, its owners, operators, employees, contractors, agents and representatives (collectively, the "Released Parties") for loss, damage, injury, illness or death arising from or connected with my participation in the rental or recreational activities, including risks that I have expressly acknowledged and assumed.

This release applies to claims arising from the inherent risks of the activities and from circumstances that the Customer has expressly agreed to assume, to the extent such release is permitted by applicable law.

Nothing in this Agreement is intended to exclude or waive any right, protection, liability or remedy that cannot legally be excluded or waived.

4. Vehicle and Driving Responsibilities

If I operate a rental vehicle, RV or motorhome, I confirm that:

  • I hold a valid driver's licence appropriate for the vehicle being operated;
  • I am legally permitted to operate the vehicle;
  • I will comply with all traffic and transportation laws;
  • I will not allow an unauthorized driver to operate the vehicle;
  • I will not operate the vehicle while impaired by alcohol, cannabis, drugs, medication or any other substance that affects my ability to drive safely;
  • I will comply with all applicable seat-belt and passenger-safety requirements;
  • I will operate the vehicle according to the instructions provided by GoatCamping Rentals.

If towing a camping trailer, I agree to follow all instructions relating to hitching, towing, weight limits, electrical connections, safety chains, braking systems and other towing requirements.

5. Recreational Equipment

If I rent or use recreational equipment, including but not limited to canoes, kayaks, bicycles, rooftop tents, camping equipment, BBQs, stoves or other equipment, I agree to:

  • use the equipment only for its intended purpose;
  • follow all safety instructions;
  • inspect the equipment before use;
  • use appropriate safety equipment where applicable;
  • stop using the equipment if I believe it is unsafe or damaged;
  • immediately notify GoatCamping Rentals of any damage, defect or safety concern.

6. Customer Responsibility

I agree to take reasonable care of all rental property and to return the rental vehicle, trailer and/or equipment in the condition in which it was provided, subject to normal wear and tear.

I may be responsible for loss or damage resulting from my negligence, misuse, unauthorized use, violation of the rental agreement, or failure to follow reasonable safety instructions, subject to applicable law and the terms of the rental agreement.

7. Personal Belongings

GoatCamping Rentals is not responsible for loss, theft or damage to personal belongings brought by the Customer or any passenger, except to the extent liability cannot legally be excluded.

Customers are responsible for securing their personal property.

8. Medical and Emergency Situations

I understand that outdoor and recreational activities may take place in areas where immediate medical assistance may not be available.

In the event of an accident or emergency, I authorize reasonable emergency assistance to be obtained for myself or members of my party when appropriate.

I understand that I am responsible for my own medical expenses and insurance coverage, except where otherwise required by law.

9. Indemnification

To the extent permitted by applicable law, I agree to indemnify and hold harmless GoatCamping Rentals and the Released Parties from claims, losses, damages, costs and reasonable expenses arising from:

  • my negligent or intentional acts or omissions;
  • my misuse of the rental vehicle, trailer or equipment;
  • my violation of applicable laws, rules or instructions;
  • my unauthorized use of the rental property; or
  • claims brought by members of my party or other persons arising from my conduct.

This provision does not apply to the extent that such indemnification is prohibited by law.

10. Rules and Rental Agreement

This Waiver forms part of the GoatCamping Rentals rental agreement.

I understand that I must also comply with all applicable rental terms, vehicle requirements, campground rules, equipment instructions and other conditions provided to me.

If there is a conflict between this Waiver and a mandatory legal requirement, the mandatory legal requirement will apply.

11. Acknowledgement and Consent

By clicking the consent button, I confirm that:

      ☐ I understand the risks associated with camping, driving, towing and recreational activities.

      ☐ I voluntarily accept and assume the risks described above, to the extent permitted by law.

      ☐ I agree to comply with the rental agreement, safety instructions and applicable laws.

      ☐ I understand that this Agreement may affect my legal rights and that I have had the opportunity to obtain independent legal advice before signing.
